In Massachusetts, employees are protected against discrimination in the workplace under both federal and state laws. Key protections include:

  • Massachusetts Fair Employment Practices Act (MFEPA): The Massachusetts Commission Against Discrimination (MCAD) enforces the MEPA, which prohibits discrimination in employment based on race, color, religious creed, national origin, sex, sexual orientation, gender identity, disability, age, and genetic information. It applies to employers with six or more employees.
  • Federal Laws: The U.S. Equal Employment Opportunity Commission (EEOC) enforces laws like Title VII of the Civil Rights Act of 1964, which prohibits discrimination based on race, color, religion, sex, and national origin, and the Americans with Disabilities Act (ADA), which protects individuals with disabilities.
  • Pregnancy Discrimination: Under both federal and state law, pregnant employees must be treated equally to other employees with similar abilities or limitations. Employers are required to provide reasonable accommodations if necessary.
  • Retaliation: Employees are protected from retaliation for filing complaints of discrimination, participating in investigations, or engaging in activities related to their rights.
  • Harassment: Workplace harassment, including sexual harassment, based on any protected characteristic, is illegal. Employers must take steps to prevent and address harassment.
  • Reasonable Accommodations: Employees with disabilities or religious practices are entitled to reasonable accommodations unless it causes undue hardship to the employer.

Employees who believe they have been discriminated against can file complaints with the Massachusetts Commission Against Discrimination (MCAD) or the EEOC. The process may involve investigations, mediation, and potential legal action, depending on the severity of the case.
